Constellate Health — Terms of Service

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. Purpose of the Service

Constellate Health is a digital health research platform that enables participants to contribute data (photos, health metrics, check-ins, and other information) to IRB-approved research studies conducted by authorized researchers at NYU Langone Health and affiliated institutions. The Service is not a medical device and does not provide medical advice, diagnosis, or treatment.

3. Account Registration

• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate information during registration.
• You must not share your account with others or create accounts on behalf of others without authorization.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any purpose other than participating in authorized research activities.
• Upload content that is unlawful, harmful, or unrelated to your study participation.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the Service or servers connected to it.
• Reverse-engineer, decompile, or attempt to extract source code from the Service.

5. Research Participation and Data

• Study consent: Participation in any research study requires separate informed consent as provided by the study team. These Terms do not replace study consent documents.
• Data you provide: By submitting data through the Service (photos, health information, check-ins, etc.), you grant the authorized research team access to that data for the purposes described in your study consent.
• Data retention: Research data may be retained in de-identified form even after you delete your account, as required by study protocols and regulatory obligations.
• Withdrawal: You may stop participating in a study at any time. Withdrawal procedures are described in your study consent materials. Data already collected may not be deletable depending on the study protocol.

6. Health Data

Supported connections include Apple Health (HealthKit), Health Connect on Android, Oura Ring, Google Health API, Fitbit, and Dexcom. Available connections depend on your app version, device, and study. When you connect a source, we access and transmit the data you authorize for the research purposes described in your study consent. Connecting an account does not replace informed consent to a study.

Google Health API access is read-only. Depending on your permissions and available records, it covers sleep timing, duration and stages; steps, distance, calories burned and activity minutes; heart rate, resting heart rate, heart rate variability, blood oxygen, respiratory rate and weight; and profile identifiers used to link your Google Health and legacy Fitbit records. We do not write to Google Health. The Privacy Policy lists the data types for each source.

We do not use health data from any connected source for advertising or marketing, or sell it to third parties, or use it to train general-purpose artificial-intelligence or machine-learning models. These restrictions also cover aggregated, de-identified and derived health data. Study-specific research, including model development, must be explicitly covered by your study consent and comply with the applicable provider policies.

Constellate Health's use and transfer of Google API data will comply with the Google API Services User Data Policy, including its Limited Use requirements. Google Health data is also subject to the Google Health API Developer and User Data Policy and, for research, the Google Health API User Data and Health Research Policy, including their Limited Use requirements. These Terms do not authorize uses those policies prohibit.

You can disconnect a source in the app's Settings. You can also revoke Google Health access through your Google Account's connections page: select Constellate Health, review its access to your Google Account, and remove access. Disconnecting stops future access; it does not automatically delete records already collected. See Your choices and controls for withdrawal and deletion options.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Account Deactivation and Deletion

• Deactivation: You may deactivate your account at any time from within the app. Deactivation disables your login but preserves all your data. You may request reactivation by contacting us.
• Deletion: You may permanently delete your account from within the app. Upon deletion, your personal information (name, email, demographics) will be removed. De-identified research data and consent records will be retained as required by applicable study protocols and regulations.

9. Intellectual Property

The Service, including its design, code, and content (excluding user-submitted data), is owned by us or our licensors. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Disclaimers

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free operation of the Service.
• The Service does not provide medical advice. Always consult a qualified healthcare provider for medical decisions.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data or interruption of service.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
